Dispute Resolution

Under the heading of general dispute resolution, BFM provides the following services:

Claims

Ascertainment of entitlement and development of strategy for recovery of amounts due;

Preparation of claims for time and / or money, to the high standard required for dispute resolution proceedings;

Delay analysis, for the purpose of extension of time claims or in support of loss and expense / damages claims;

Formulation of defences against claims;

General advice throughout the life of a contract on the appropriate notices to issue / records to keep in anticipation of potential claims (for or against).

Representation / Advocacy

Negotiation of entitlements / claims through to settlement;

Adjudication – advice and full representation in all matters;

Arbitration – advice and full representation in all matters;

Mediation – advice and full representation in all matters.

Contracts including Bonds, Warranties and Guarantees

Vetting of proposed contracts and other contract documents and their negotiation;

Drafting of contracts / subcontracts;

Specific advice on interpretation of contract / subcontract provisions;

General advice on construction contracts.
